This role is designed for a practicing attorney with deep, practical experience in consumer loan and mortgage loan servicing and collections law and who can provide real-time operational guidance to the Servicing organization. The Assistant General Counsel will provide daily support to the Servicing Team, advise on loss mitigation programs, collections strategy, default management and regulatory compliance, and will be the go-to legal representative for matters affecting serviced loan portfolios, customer communications, and servicing operations.</div><br><br><h3>Essential Job Duties and Responsibilities:</h3><ul><li>Lead compliance analysis and policy development under Reg X (RESPA), Reg Z (TILA), FDCPA, UDAAP, TCPA, etc. and applicable state servicing and collections laws, GSE and agency servicing guidelines.</li><li>Draft, review, and maintain loss mitigation policies, collections strategies, and servicing procedures, ensuring alignment with regulatory obligations, procedural requirements and investor obligations.</li><li>Identify, assess, and mitigate legal and regulatory risks and advise on structuring for current and new investment products and strategies to ensure compliance with applicable laws.</li><li>Monitor regulatory developments and advise on implementation of new rules affecting servicing and collections operations.</li><li>Review and negotiate vendor contracts and SOWs supporting collections and default management functions (e.g., third-party collectors, BPO servicers, foreclosure counsel).</li><li>Partner with Capital Markets and Portfolio Management on servicing representations, covenants, and compliance requirements in asset sale and securitization transactions.</li><li>Support regulatory examination management and respond to consumer complaints escalated through CFPB, state agencies, or litigation channels.</li></ul><h3>Required Skills, Knowledge and Abilities:</h3><ul><li>Minimum 10 years of experience as a practicing attorney, with substantial time spent in consumer loan servicing, collections or default management — ideally including in-house experience at a consumer finance and/or mortgage servicer or subservicer, GSE/agency approved seller-servicer and/or consumer finance lender.</li><li>Deep working knowledge of servicing and consumer debt collections laws and practice and applicable state collections and foreclosure laws (e.g., FDCPA, TCPA, FCRA, UDAAP, TILA, RESPA, ECOA, etc.) and related title and lien resolution issues.</li><li>Demonstrated experience advising on loss mitigation structuring and post-default strategy in a consumer finance, mortgage finance and/or home improvement lending context.</li><li>Fluency in FDCPA and TCPA compliance for collections outreach, state collections licensing requirements and regulatory classification of collections operations.</li><li>Familiarity with AI governance and emerging regulatory frameworks applicable to AI use in collections and financial services operations.</li><li>Proven ability to deliver clear, operationally actionable legal guidance and to own and stand behind a legal position in a fast-paced business environment.</li><li>Membership in applicable state bar in good standing.</li><li>Juris Doctor degree from an ABA accredited law school.</li><li>Able to juggle multiple workstreams under tight deadlines.</li><li>Clear writing and verbal communication with business professionals and counsel.</li><li>History of working well with business professionals, and with cross-functional teams (internal and external).</li></ul><br><div><span style="font-size:18px;">Compensation: $240,000–$260,000 annually</span></div><div><br></div><div><b style="font-size:15px;">Additional Information Regarding Job Duties and Job Descriptions:</b></div><div><br></div><div><span style="font-size:15px;">Job duties include additional responsibilities as assigned by one's supervisor or other managers related to the position/department.
